For those of you who are not aware, my YouTube account was terminated last week and almost 100 rare circus and clown clips that I'd posted were removed due to "copyright violation".
I'm not convinced that the agency registering the complaint holds the copyright on these videos and am almost positive that the clip in question is actually in the public domain!
And the fact that NONE of them are posted in their entirety and only posted there so that they could be imbedded here for educational purposes should more than satisfy the requirements for "fair use" for educational purposes.
I'm not SELLING them, I'm sharing them! Leave it to lawyers to figure out a way that a person can't GIVE something away!
From now on I'll be posting my videos directly to blogger but I'd like for You Tube to reinstate the account so that the previous videos will continue to be available.
I'm not going to re-edit and re-post 100 video clips.
I don't seem to be getting anywhere with their customer service folks. Perhaps a letter writing campaign will help.
If you'd like to see the videos that I've posted here be made available again PLEASE send an email to copyright@youtube.com and let them know that those clips DO serve an educational purpose here at CLOWNALLEY.NET and you like to see the account reinstated.
My YouTube ID was cashincomedy.
Maybe that will help. Who knows?
what is your youtube user name so I can send them an email about it?
ReplyDeleteSo which clip did they say was in violation?
ReplyDeleteWe are dyeing to know!
So here is what I wrote to them for you!
ReplyDeleteHope it helps!
"To whom it may concern,
I would like to let you know that I do not agree with the termination of the youtube poster Cashincomedy.
Pat Cashin is the host of the comedy/clown blog "Clownalley.net" and he uploads videos using youtube and posts them there for teaching and the study of the fine art of circus clowning.
He does not sell anything, he is not promoting his or other peoples work.
Most of us us it as a library for reference for classic comedy clown gags.
I myself, a professional Circus clown on tour with Ringling Bros. circus, constantly use it to research old gags and and helping teach the new comers.
Please reinstate Mr Cashin and also allow the 100+ clips he had posted be once again viewable to the Public.
Sincerely ,
LarryClark

Disney didn't buy youtube, did they?
ReplyDeleteSheesh! Sounds like one of THEIR tactics (AGH!!! Umm... can I be sued for saying that???)
I'll put in my two-cents-worth to them, too. What a crock. Next thing you know, someone'll try to copyright humor.

Taking Larry's letter as model, 'cause my english is not the best... Here is what I wrote. I hope it helps too. I'm sending your post to all my clown-friends to see if they write something too.
ReplyDelete"To whom it may concern,
At the begining of the month, to the surprise of all the world of clowning, the account Cashincomedy was suspended.
Pat Cashin is the host of the comedy/clown blog "Clownalley.net" and he uploads videos using youtube and posts them there for teaching and the study of the fine art of circus clowning.
To your information, this rare material is very very hard to find and soo useful too the art of clowning you'd never imagine. It's the only "popular" place were anybody interested in this fine art can find videos of classic comedy clown gags.
We, clowns have been ages disconected from other artforms because of the dificulty to record the essence of our art and when it's been done it's very rare to find material because is not available in any format.
Long time ago, clowns, didn't like to share their number because of the competition among each others and the frigthen, always right, of beeing copied. Nowadays, we've open our minds and show everyone and share with everyone what we do, because we've understand the important thing about clowning is how you do it and not what you do.
I would like to let you know that I do not agree with the termination of the youtube poster Cashincomedy.
He does not sell anything, he is not promoting his or other peoples work.
For most of us it as a library for reference and a place to learn.
I myself, a professional clown, constantly use it to research old gags and it helps me on teaching to others interested in this art-form.
Please reinstate Mr Cashin (Cashincomedy) and also allow the 100+ clips he had posted be once again viewable to the Public.
Sincerely ,

I'm so upset they took off your YouTube! It was really educational and also really informational - besides - its not like you can get that stuff anywhere else! I'm really sad for your loss - your YouTube was a great great site and full of fun clown antics!!! :O)
ReplyDeletePat, I'm shocked by that new.
ReplyDeleteI'll do my best to make this circulating around the world among clowns and artists.
I'm an amateur clown from Finland, and Clownalley.net videos has been really helpfull, to improve my clowning. I'm clowning free in hospital and some charity associations. Let there be also joy in bad times too. Please return the videos.

If the issue was over musical comedy, yeh, I have heard that his kid got stingy in times past with the filmed material to video/dvd. Don't know what the beef is on that score. Haven't seen alot of that stuff except on eBay or Amazon ...
ReplyDeleteNice parade pics, btw.
